My husbands ex wants to sign over her parental rights over their 6 year old son because she doesnt want to pay

child support for him. Also stated to him that she wants him to do it before she files for income tax. She hasnt paid a dime since September. This woman has caused us so much chaos in our lives because of child support and custody (she was found mentally insane).

Can in the state of PA she just sign over all rights? She said after she gets her income tax and finishes school (wow) things will go back to the same thing as before (her blowing her visit off every week).

Isnt this a permanent thing that cannot be reversed? We’re not buying it from her and have called our attorney but she didnt call us back yet. She thinks its just a way to get out of child support and so she can get her refund.

 

What are the IRS taxes on executor “Fee in kind”?

My mother died in 2008 and I was the designated executor for her modest estate. It was a huge amount of work (clearing out, fixing up and selling her large, cluttered house among other things like filing all the documents and dealing with the accounting). I was entitled to an executor’s fee but chose instead (with the agreement of my two siblings) to waive a cash fee and take possession of her 6-year old car instead, which was worth $4,000 (we reported that value as my “fee in kind” on the PA state inheritance tax forms and the final settlement of the estate net value after expenses). I’m filing her final tax forms right now and my own and I’ve gotten two different answers on how I report the $4,000 value of the car as “income” on my return. The estate attorney says I not only have to declare the $4,000 as gross taxable income but I also have to pay self-employment Social Security tax on that amount. On the other hand, a good friend who is a professional tax accountant says that though I do have to list it as “miscellaneous income”, I DO NOT have to pay social security taxes on it.
Unfortunately, reporting this “added income” is going to cost me over $700 in federal income tax. I hate to also have to pay social security on it. Anybody know if this is necessary or not? And do I really have to report it as “income”?

I realize I won’t get the answer in time to file today, but I expect to have to file an amended return anyway since I have run out of time to pull together a number of deductions that I could use, especially medical for both her and myself, for last year. So, if you have an answer, I would appreciate it.

After Republican presidential nominee Sen. John McCain chose Palin his running mate and reporters asked for the records, Palin ordered changes to previously filed expense reports for her daughters’ travel.

In the amended reports, Palin added phrases such as “First Family attending” and “First Family invited” to explain the girls’ attendance.

“The governor said, ‘I want the purpose and the reason for this travel to be clear,’” said Linda Perez, state director of administrative services.

When Palin released her family’s tax records as part of her vice presidential campaign, some tax experts questioned why she did not report the children’s state travel reimbursements as income.

The Palins released a review by a Washington attorney who said state law allows the children’s travel expenses to be reimbursed and not taxed when they conduct official state business.

how does a 14 yr old, 17 yr old, and a 4 yr old conduct official state business ?
THIS isn’t about her children….this is about her using tax payer money for their travel expenses….

this is ILLEGAL….

I need advice on where to start dealing with this problem!!!?

Five years ago my fiance went in to H&R Block to have his taxes done. He is a commercial fisherman out of Dutch Harbor,AK. That year ,when the fishing season ended and he was home in Oregon,he worked for two weeks at a jiffylube.He ended up owing almost 900$ in taxes &H&R told him it was cuz he worked two wks in Oregon they taxed ALL hispay. He told him if he hadn’t had “Oregon income” he wouldn’t have had Oregon income tax .So he figured he wdn’t work in Ore on his off time. he hadn’t filed taxes for afewl yrs when we got together.federal too.But his company withholds federal for him but no state since he believed he didn’t need to pay it. I take it all to a tax dude and he figures out he owes a BUNCH. He files and pays off the latest year. He now owes almost $40,000
after interest, penalties etc,& they filed a distraint warrant .he gave me power of attorney to represent for taxes since he is gone. The DOR doesn’t wnt to drop much penalties etc. How cn we get it to justtax orig. owed

i need tax advice on a real estate transaction between my ex and me it was suppose to be an exchange of assets

i really need legal help on this. in the divorce 2002 i got a piece of property. by may of 2004 my ex had ruined my income on that property and put me in a position to sell it back to him. i agreed after stating that the only way i would was an exchange of prior marital assets so that i did not have to pay taxes on the gains of the sale. i gave my brother power of attorney to close the deal for me because i was out of the USA. somehow my ex screwed me and his attorney 1099ed me to the tune of over $100,000 to pay taxes on…to the feds and the state i owe almost $25,000.00 I don’t have the money and my acct says she sees no way that i don’t owe this. i’m not faulting her. is there anything that i can do legally about this…i am just so tired of trying so hard to do the right thing and then getting screwed any way…my ex was always stiffing the government when he really owed them..and this is one more thing he pulled on me and is laughing about. forgive me i feel sorry for myself

 

LLC w/S-Corp Tax Structure?

Hi,

I am establishing an LLC, but with an S-Corp tax structure. I talked to an attorney about this, and mabye regretting my choices. I’m confused as to what taxes and forms I need to be filling out throughout the year. I would have lost more money by simply keeping the LLC structure…so it sounded enticing.

I am an employee of the company, recieving an income from it…so the company now has an employee. I recieve a monthly deposit from the “company” which I am the sole manager of at this time.

I also withdraw my dividends as an owner, which I know is taxed differently.

I was trying to figure out what I need to be doing for the “company” by having an employee. In reading materials it mentioned that I should be paying taxes throughout the year…but I’m uncertain as how to do this.

Or, do I simply fill out the K-1 for myself at the end of the year along with the 1144 (something form)

We’re talking small amounts of money, like $1600 a month…so going to an accountant would drain me out, hence why I’m asking and seeing the feasability of me doing it on my own with Quick Books.

 

My Aunt passed away and I received a percentage of her house that was sold.?

I received a 1099s from the attorney who handled the estate. Is
the proceeds considered income or inheritance. How is this
delt with on a tax return.

Ok, in 2003 someone at H&R block told my fiance that he had to pay state tax on ALL of his income because he worked in Oregon for 2 weeks out of the year. They told him if it wasn’t for those two weeks he wouldn’t have to pay because Oregon has income tax and he wouldn’t have had Oregon income. So he just stopped working his pt job in Oregon. He fishes in Alaska and works shipyard in Seattle at the end of the season. Neither state has income tax. they have sales tax. He is always gone during tax time and hadn’t filed for a few years when I met him. His previous gf was supposed to help him with it but didn’t ever do it. He does get federal taken out of his pay but they don’t withold state tax for him. So all these years he had assumed he didn’t have to pay state but of course since he lives in Oregon that was wrong advice. I filed all of the years for him and he ended up with owing a pretty large amount-about $18,000. Well he wantede to look into a settlement and kept waiting till he would have a lump sum of cash or just didn’t want to face it. With the extra years and the penalties he is now owing $50,000 which will almost double after April 15th. He finally gave me power of Attorney over the taxes and told me to handle it for him. I have looked into some of the laws and talked to an attorney but was told that Oregon is notorious for NOT negotiating and that hiring an attorney is not cost-effective for what little they might be able to get taken off. I guess federal taxes would be a different story , or even another state. Basically I am scared to death to make the final decision oon whether to just set up a payment plan or try to fight them since he went to them and wasn’t trying to evade taxes or anything. He is honest and would never lie to them but they are being so rigid! Is there anything I can do to try to get it down to what he originally owed or at least close?? It just seems so unfair to add so much on when he could have probably just lied and used a washington address since he is from there and not had to pay near as much to Oregon. PLEASE HELP !!! I’m running out of time and what I decide is legally binding. Also he unmarried , no children, high income so no “sympathy” situation to present.
C’mon people! Someone who is familiar w/ Oregon tax law please!! I’m so desperate!!

legal & tax advice buying a home for in-laws (michigan)?

my wifes parents are claiming bankruptcy (business closed) and are leaving their house. we would like to buy a housethey could stay in, near to us (within 5 miles). Some lenders require more (down payment/higher rate) because this is an “investment property” but i have been told that they are family and this could be my second home (lower down/lower rate). my attorney states that we should have a lease, and would pay taxes on a fair market rent, but we dont plan on charging them. Will I have to pay taxes on a non-existent income? can I still get the tax deductions for mortgage interest and city taxes I pay? can they homestead the property? I’m lost. any knowledgeable direction is greatly appreciated. Basically, can I buy a second home for myself and let my in-laws stay for free? Will I have claim this as income producing (even though it’s not)? Are tax advantages better one way or another?

 

Tax help on the elderly?

Please, only answers from tax professionals. My mother has been living with us for 14 years. She lives with us because she is unable to take care of herself and does not make enough from social security to pay her bills plus her medicine and medical bills. She is now at the age of 85 and my husband has been on disability for the past 5 years. I am the only one making an income. Does anyone know what kind of tax help I can get or if I need to see an attorney or seek other professional help? With prices on everything going higher, its starting to show. Thank you. Deborah

 

Federal Tax Question – Is it A Rental Property???

I inheritied my fathers residence in 2005 when he passed away. One of his requests was that his then girlfriend be allowed to remain in the residence rent free. The attorney that handled the estate setup an agreement that she would be able to remain in the house rent free for 5 years, she signed a lease, etc. The lease reflects $0 annual rental payments.

My question is can I still treat this property as a rental and take advantage of all of the tax benefits that accrue? I know there has to be an effort made to rent and there are issues if the rent charged is below the average rent for your area. Worst case I guess would be I can only deduct property taxes paid but not homeowners insurance, depreciation, etc…

Next question – I have recently paid said individual a sum of money and in return she has terminated the lease agreement and has moved out of the residence. Can I deduct the early lease termination payment I made to her from my income?

Do not meet income guidelines to bring Fiance here?

I am in the process of sending for my fiance to come here and we will get married. I am on the edge f the income requirements to sponsor him. Because of my taxes. The income that I had for 2009 was much lower than the income that I have now and for the rest of the year-God willing.Because I have more hours at my job and it is steady employment. I can prove this with my pay check stubs. Is this acceptable? Even though my last year taxes 2009 will show lower income?

Estate/trust tax question.?

A number of you seem very knowledgeable out tax issues, so here you go. I am attempting to prep a family members 1041 related income to her estate (the estate is small, but has managed to stay open for a while). There is taxable income in the estate, all interest, but there were distributions to offset it all. However, this means that there needs to be k1s to accompany it. Since there were attorney fees paid out of the estate the net income is less than the total interest income. When reporting the income on the k1s, do I split up the total interest received, or do I report the interest income net of the attorney’s fees?
