How about requiring the loser of all court cases to pay the full court costs and attorney fees of the case. This would provide protection against frivolous lawsuits and would save tax dollars. Why should a victim of a frivolous lawsuit (such as that ridiculous lawsuit against McDonald’s by somebody who blamed McDonald’s for their inability to control their weight, the ridiculous lawsuits against the video game industry blaming them for the criminal acts of a few psychopaths, or those ridiculous lawsuits claiming that President Obama is somehow ineligible to be president) be punished by having to pay the costs for their defense? Doesn’t the absence of a loser pays rule amount to encouragement for people to abuse the legal system? Shouldn’t there also be stronger penalties against pressing false criminal charges, another event which happens all too often?
