He already had his office but dissolved his partnership and reformed his LLC, first he claimed it was done before we were married, but when the judge ruled in my favor over interim support….he changed that to after we were married and is now trying to include the back payroll and income taxes going back to 2001 (we were married in 2004). Can he do this?

My husband had an outstanding credit card debt that was being taken from our income tax return for the last several years.

The debt was sold, like it was never recouped, and they were able to take it from our bank account. When we contacted them about it, they said their records did not show the debt was paid. They bought it as an unpaid debt and are taking it out.

We got copies from the IRS showing where the debt was taken from our tax returns and not only was paid in full, but overpaid by $1000.00.

They said said they would look into it, but then just hit our account again, a second time, emptying it. How can we stop this? HELP!
The tax refunds they are taking are our State refunds. We do not know how they are doing it. We have never seen any type of court paperwork…..been served……gotten any in the mail…..nothing. Just when the tax return is due a letter comes in it’s place saying it went to pay a debt and to whom. (Providian National Bank Collections)

Now a different attorney had hit our bank accounts…..twice now. Using the same debt as what the other attorney used to take our tax returns. When we contacted them after the first time, letting them know that our tax returns had already covered this debt, in full, they wanted proof. We made copies of the letters, and had a printout from the state, and sent it to them. They said they would look into it……..but never did. They just hit our account again.

We are trying to find out what we can do to get this to stop, and what we can do to get our money back. This debt is way over paid now.

When the Judge makes a totally wrong decision and the attorney has no choice but to file against the Judge’s decision, what kind of strategies work best in this situation? Thanks.

We are talking about child support recalculation. My husband’s ex was supposed to provide her tax returns and other paper work in August’08… still has not done it. My husband’s attorney filed a motion to compel against her for not providing the documentation and just now (in December!) the Judge denied the sanctions without any explanations. Another fact is that my husband’s ex used to work at that court house not too long time ago… very crafty business, isn’t it? How would you handle it?

PS… Can’t believe Judges like the one I’m describing here exist and practice in the US!!! OMG..

I have a Power of Attorney, signed by my husband in 2001, which I used for buying/selling homes, cars, filing income tax, etc. No problems. Should I be able to use it for banking matters (separate accounts), or has it expired? He’s not available, due to “jail,” and keeps telling me that it is still good. The bank doesn’t seem to think so.

My husband and I filed Chapter 13 bankruptcy in 2006. My attorney had my husband change his tax allowances on his paycheck to insure that we would not get a refund. The attorney based our bankruptcy payments on the higher tax allowances. This tax allowance level does not give us enough to pay for our federal taxes. Because of this year we will owe over $4000 in federal taxes. We are paying alot of money to the trustee weekly almost $350. That’s over $1500 a month to the bankruptcy court. I believe that paying our taxes is a necessity and should have looked at the amount we would pay in federal taxes. We are barely paying bills now. I was working at the time of the bankruptcy filing, but suffered a back injury and can not work. My profession was a nursing assistant. I would love to return to work but no doctor will allow me to care and transfer patients with my back. Any advice?

After having Attorneys General under Bush with questionable ethics, it seems to me that Obama might want to nominate someone for this position who is beyond reproach.

Eric Holder supported Bill Clinton’s pardon of Marc Rich – a man who made illegal oil deals with Iran during the 1979 Hostage Crisis and was also wanted on charges of tax evasion when he fled the country in 1983.

In 2004, Holder helped negotiate an agreement with the Justice Department for Chiquita Brands International in a case that involved Chiquita’s payment of “protection money” to the United Self-Defense Forces of Colombia, a paramilitary group that has been designated a terrorist group by the United States government. In the agreement, Chiquita’s officials pleaded guilty and paid a fine of $25 million with the understanding that their identies would remain secret. Holder represents Chiquita in the civil action which grew out of this criminal case.

My gut instinct tells me Eric Holder is a scumbag who is no different than Alberto Gonzales, another scumbag. Does anyone have anything good to say about Holder?

Running out of viable ideas and time to locate a legal malpractice attorney in the Los Angeles area.

I want to purchase an existing tax law practice and the former attorney (partners) want to be employees of the new firm. If not a licensed attorney, can I own the firm…what are the limitations of the practice name, I am a tax practioner, what limitations would I have on how I can represent the firm and myself personally…if any?

The attorney said he wants $3500 to do the business formation, register the LLC, sales contract, and establish the tax laibilities, etc. He basically said that fee will include everything. He said he would charge about $2000 for services except forming the LLC and registration etc. Please give me some figures based on experience.
