My mom is having a short sell that might close this year for one of her condos. However, she has been unemployed for a while and can no longer afford her second condo. So she plans to short sell the second condo next year, because she is still not finding work at all. of course, as soon as the first condo sells , she will move to the second one as her primary residence and try to short sell that one too.
Now my question is how this may impact her tax situation? both condos where bought for 500K and there still about 425K owned (divide by two for each). Could she be better off just going to bankruptcy instead of trying to do all this short sales? And I am worry about the IRS trying to collect on her for dismissal of the loan money. And obviously we cant really afford an attorney. So here we are in yahoo trying to see what might be the best option.
PS: Both loans for condos are the original loans and they have piggy back loans attached to them. if u need any more info just let me know and I will post. Thank you in advance for any suggestions.

I’m aware of most of the principle websites, but keep wasting time linking to the spam & ad types.

i’ve seen many posts on this forum lately in reference to an income tax revolt. well, if you will all chip in a lot of money…do you have it?…to pay an attorney to form a class action lawsuit and bring it all the way up to the u.s. supreme court and then argue it even more, you might have a lawsuit, but uncle sam will still tax you as you are fighting against these taxes, you can be certain of that.
because i have seen so many questions about the legality of the federal government taxing you and i, i wish to know which of you think that these taxes are in fact legal and which of you don’t think these taxes are legal, and why. in other words, although most of you are not judges and lawyers, if you are informed, how would you back up what you believe? please give sources, as i will give to you now.

one of the folks that answered (i myself don’t think that the best answer award went to the best answer, i think that the best answer was ignored–it is below the award, which was an answers community vote, too bad) included a link to a discussion about the frivolity of lawsuits entered by individuals that refused to pay federal income tax, which, if you do not believe that the 16th amendment to the constitution of the united states is valid, and if you think that the laws are not ours, but are the government’s, is an interesting read:

i also wish to add that the above link refers to INDIVIDUALS that brought suit, but not a large group of american citizens who all believe that the 16th amendment was not legally ratified and that therefore, no federal income tax should be levied against us. (which reminds me, i want to state that we ourselves would be able to bring this country out of the depression that seems to be coming, immediately, if the comptrollers and accountants and bookkeepers of your employers did not HAVE TO take federal taxes out of your paycheck, since you’d sure have more buying power, enough, too, to make that mortgage payment if you are facing foreclosure)!!! (and, if those facing foreclosure could make those payments on time, they could get out of foreclosure and then the real estate market would get back to its historical cycle, which is this: 2 years a seller’s market, followed by 5 years of a buyer’s market, over and over and over again, so that income and savings can then buy those houses that got to be too highly priced in the 2 years of the seller’s market… and i KNOW, because for 26 years i have owned quite a reputable real estate company and been licensed in IL, and i am very happy that i refused to participate in those risky loans that put so many people in deep, deep doo-doo as is proved today–i.e., i KNOW better by long experience and ethics that i disagree with taking that almighty commission buck by placing my folks into an impossible situation which they would then blame on me). (and take this as a given: i am published for writing of the real estate industry all about the real estate industry, so know that all of it, from unimproved land up to the sale of improved, built on, pieces, and all of those workers and materials that make it improved represents almost a THIRD of our GDP, so, it is damned important to our economy and it is important that those facing foreclosure pay their mortgages!!!).
so then, i ask you, mr. or ms. john or jane q. public, is uncle sam illegally taking money from your income that you feel you could use wiser, in order to fund ITS programs, and to fund ITS very, very high employment rate, even today, when almost every other employment sector in the united states is telling us that they are laying off even more and more thousands of workers every day?

well, if we want to change the tax laws via political activism, what route would you choose?
i am an independent voter, are you? the reason i am (other than i don’t want to vote a straight ticket) is because i do not want the parties to know WHO i plan to vote for.
why don’t more of you begin to look at the 3rd party candidates? there are the libertarian party, the constitutionalist party, and more. there is even a communist party.
i think that the “apportionment” clause of the tax laws make it invalid, not only that it was not fully ratified as required by law. but put the two together and then ask ron paul. btw: if you wanted to categorize me with any party, you may as well call me a “paulista.” that man knows about money!
EDIT: it does not make sense to quote the internal revenue code as it applies to this question because you’d have to first have constitutional law before you go to any code, for anything, in this country.

I am wondering if lawyers fees are tax deductible for child custody cases. The divorce was in 1998 but we have had to go back for other reasons for schooling & etc. Are those fees paid deductible? Thanks for any help.

Tom Cryer, a Shreveport, LA, trial attorney who has refused to file
tax returns for years was recently acquitted of evasion and willful
failure to file charges filed against him by the federal government. At
the trial Tom told the jury that there is no law making him liable for
the income tax; that his fees, personally earned by his own labor, were

PepsiSlime—having perused your answers list I see they are almost all regarding taxes of some sort….so you are almost certainly biased for some reason….what would that be?
Pep—It’s become obvious through research that your career and livelihood revolve around taxes and the payment thereof….it renders your advice biased at the very least….you may well be right in the end but because of your profession your motives will always be in question.

Each year my employer does not deposit any income he receives in the month of December. He holds onto it at his office until January of the next year and then deposits it. Because he does not deposit the money until January, he does not report the December income on the previous year’s taxes. Is this legal or ethical? He is an attorney by the way. Because I have detailed knowledge of this, I am worried I could be held liable for some kind of tax fraud if the business were to ever be audited. Do I have any cause for concern?

the attorney general says their resources are limited and i have to do a lot of the research myself. i have no idea where to begin to prove his assets exceed his “reported” income.
the attorney general’s office has a child support division. they are the ones who reviewed our case. and they reviewed his income tax return. but he has other income, that is over seas. his assets are far greater than the income he is filing for. they say it’s up to me to prove this.

I was involved in a minor car accident – I scraped a parked car as I was pulling out. I called the cops, and provided my insurance information, and reported it to my carrier the day of the accident. I have gotten letters from an attorney representing the guy whose car I damaged, and I think this is illegal. Why would he contact me directly when he has my insurance information?
I want to know if this is legal, and if it’s not, how can I complain to the state bar association?

As to oklatom’s rather snarky response, in what scenario is an individual meant to be contacted for damages when all insurance information was provided at the time of the incident and duly noted on the “property damange” report filled out by a police officer? It’s my understanding that this is the point of having insurance, and providing proof of it at the scene, and attempts to contact an individual directly smell strongly of intimidation tactics to me.

Is the Prepaid Legal membership really a ripoff?
Pre-paid legal services, inc. is the most widely known company that offers legal expense plans. There are other company’s but Pre-paid legal services is the oldest. They have been in business since the early 70’s.
I was sold a prepaid legal membership two years ago by a friend. The way he explained the membership to me was that it was a life events legal plan. This meant that Pre-paid legal’s membership is designed to keep customers out of legal trouble before it gets too big. Prepaid legal offer’s a range of services from legal consultation, letters and phone calls on your behalf, contract and document reviews, wills, power of attorney’s, moving traffic violations, lawsuits, audit’s, and will’s.
When I got my membership I didn’t have a will and I was too afraid to try to fill it out myself without an attorney so that part of the membership was a plus. I also liked the fact that I had help with speeding tickets. There are alot of speed traps in South Carolina where I reside so that part of the membership gave me peace of mind.
However, I think the most POWERFUL part of prepaid legals membership is legal consultation. For a measly $17.00 a month I have an entire law firm on retainer for legal advice. If I need to speak to a tax attorney, real estate attorney, family law attorney, criminal attorney, etc. I can talk with them without worrying about being billed.
I run a small business and need access to advice throughout the year. The business consultation I have received has saved me loads of time and money.
$17.00 x 12 months = $204.00 a year.
Is a Prepaid Legal membership a ripoff? That all depends on how you view your membership.
There are exclusions to prepaid’s memberships that will not give you FREE coverage for some of the most popular legal problems. “Divorce”, “Child Custody”, “Bankruptcy”, and “Drugs and Alchohol”.
