If in the parenting plan the father and mother splits years on claiming the child for income tax?

In the parenting plan it says the father shall claim the child every even year starting in 2010 and in every odd year starting in 2011 the mother shall claim the child on income tax. If this is written out and the mother claims her for the fathers year knowing she shouldnt is she still able to and will she get away with it? What I have heard pretty much is that the first one to file is the one that gets the credit. Of course the father hasnt claimed her yet but custody has just been settled a few days ago and he was awarded joint legal custody, joint physical custody. If the mother does this then is there something the father can do about it? His lawyer says to come back to him if this happens and they will fight for it and if she has to pay him back she might even have to pay back the lawyer fees for the father because if it wasnt for the mother doing this they wouldnt have to go to court anyway. I have also heard that you can get her for fraud if she does it.

What do you think of this tax plan?

The current tax code is so cumbersome that few people understand it which makes it favor those that can afford professionals to calculate taxes and find loopholes.

I would propose a simple tax plan based on the poverty level for each tax year. The plan would give each taxpaying unit (family or single) a credit equal to 1 1/2 times the current poverty level which is based on the number of people in the household. Each person could only be claimed once and would be tracked by SSN. Everyone would then be taxed an equal amount ( or possible a two tier tax level) with no additional deductions of any kind. Corporations would pay the same rates without the poverty deduction or with a set deduction.

This would make the system fair for everyone. The one objection I have heard so far is that it would put a lot of accountants, tax lawyers, and IRS agents out of work. I failed to see the down side.

KROLLOHARE: Why should people that make more money pay a higher rate in taxes if they don’t receive more benefits? The ability to pay more should not be the same as a responsibility to pay more unless you agree with Biden that it is “patriotic to pay taxes”. Other forms of taxes work the same way. There isn’t a different sales tax rate based on income.

What is Plan B when Obama tries to tax the super rich only to find they have placed their money overseas?

Historically, Democrats social change hinges on the ability to tax the super rich; but, in reality the super rich have super accountants and super lawyers who know ways to hide their fortune from the tax collector.

Ultimately, it is always the middle class who ends up picking up the bill.

How do I reduce my income tax liability if I do not plan on getting married or having children?

I. I plan on making $150,000+ a year at a big law firm once I leave law school in the spring of 2013.

II. There is the standard deduction, personal exemption, charitable deduction, and earned income tax credit. What other deducts exist?

III. If I have to pay more money to charities to prevent as much as legally possible from going to the government to fund wasteful spending and social or welfare programs that is fine by me.

how to stop my chapter 13 plan if my lawyer will not stop it unless i pay 1000.00 to roll it to chapter 7?

I filed to save my house and car since then ive lost the house and the car should be payed off now.gross is 1048 weekly and payment plan is 342.00 a week and i still have to pay med/dental/state and fed taxes.it is too difficult to make this continue with 4 kids.the attorney ignores my pleas to stop my payroll deduction.by the way my new home mortgage is 1100. so what can i do.It is still going to be effective untill 2010 and on my credit till 2014
The part of losing the first house is like this we had the 13 plan set up at one rate which was 196.00 weekly then there was a modification to 324.00 12 months later so naturally we fell behind which voided the agreement with the lender who proceeded with going after there property.the area it was in versus another area was worth me getting a newer home from a lease to own company before we didnt have any place to live.after making the payments on time my wife was able to purchase the home with me on the deed.no lies needed im looking for help to this never ending horror.Hindsight tells me that it was easy to file but its like having a life sentence with no representation.

Obama Tax Plan good or bad?

I find this amazing that no one has really pointed this out that I know of about Obama’s tax plan. If he taxes Big Companies Like Walmart, Target, Oil Companies, etc.. they will have to raise prices on everything they sell to re-coop the taxes that Obama’s tax plan will do. I dont know about you but I like to pay less for gas and food items. That is just common sense. I don’t understand why people don’t get this. Also Obama says he wants to give 95% of Americans a Tax break but only 45% of Americans pay income taxes. How is that going to work. He is going to send them a Check I.E. Welfare Check. If someone keeps getting a check instead of working for thier money why would they ever want to get off welfare. Whatever happend to working hard for your money and supporting yourself?? Other countries do not even offer welfare you have to fend for yourself. If there was no welfare I am sure you would think twice about having a baby before you can offored it or not taking that job beause you just don’t want to work or whatever. Also Obama Wants to tax the capital gains and raise the taxes on them, but history shows than when you lower the capital gaines taxes the goverment takes in more revenue than when you raise the capital gaines taxes. And he was asked this in the Debate with Hillary and it was said to him “but when you lower the capital gains tax revenue goes up.” And he said ” Well it may or it may not” What the heck kinda answer is that. Also if you raise taxes on the wealthy it is not going to do any good. They have the money and the resorces to hire tax attorneys lawyers etc to legeal get around these taxes so what good does that do. Plus most of the rich own companies that employee you. Heck if I was rich I would do the same thing. Also history shows that when you have higher taxes it creats tax evasion and less productivity out of the us work force. I. E. people do not want to work as much because they are getting taxed to death. What does he not get here? I thought America was the country where you could become a Millionaire heck thats what America is all about. I guess Obama does not share that with us common folk. Obama is going to take YOUR HARD EARN MONEY AND SPREAD THE WEALTH AROUND. LET ME SAY THAT AGAIN OBAMA IS GOING TO TAKE YOUR HARD EARN MONEY AND DO WHATEVER HE WANTS TO DO WITH IT. PEOPLE WE NEED TO WAKE UP HERE!!!

What are the economic benefits of the immigration plan? Are they hard criminals?

When you say criminal.. do you mean because they broke the law? Do you believe there should be no repentence? Give them a chance to pay for their illegal entry (roughly 10K after attorney and appliation fees… a lot more than entering legally.. Ive done the research for a friend). We should allow them to finance the dollars (a lot of them can’t afford it up front.. I agree)…
Economically speaking and as it relates to US security, why would you want them to stay in the shadows? Doesn’t make any sense.. they are not going anywhere.. deportation is near impossible and would create huge gaps in our current economy.
Lets talk economics (I have a masters from Duke in finance)… lets do it simply.
12,500,000 Immigrants X $10,000 a piece…..mmmm… that would be a $125,000,000,000 surplus to the economy… in addition, they would be required to finally pay for their taxes (those that are currently being paid under the table), contribute to the healthcare system (rather than us citizens currently paying for their 4%). INS wont be so saturated and now they can focus on the non-registered… (possibly security threats) People who use the money factor are clueless… we can’t fill the lower paying jobs.. look up southern California (lots of illegals)… restaurant owners, hospitals, cleaning services, and farms are paying a premium to fill these “lower class” jobs… they still cant fill them… This is everywhere in the country.. do the research… Economically, it doesn’t make sense..
Lets talk the criminal avenue… but they are illegal criminals…? they broke the law… give me a break.. have you ever stole anything when you were younger.. ever drove 46 in a 45 to get somewhere just a little quicker… ever cheated a little on your taxes… these are all crimes my friend… even speeding or cruising through a stop sign… this country is governed by over 29,000 federal laws, and on average in my state (NY) an additional 120,400 penal law codes (increases about a 900 per year)… not including vehicle and traffic law… Everyone bends the rules.. and commits a crime… time to time.. Many illegals come here for a chance for a better life… if you were in Mexico, living in poverty, wouldn’t you at least try for the benefit of your family? Think big picture… there are enough punative damages in fines they would have to pay.. (to make it fair for those who came here the pain in the rear legal way) if they don’t, seek them out deport them permanently…. Use the surplus dollars to firm up the border… help the economy, and most importantly enforce the laws/borders moving forward..
