What info should I fill out on an amended tax return to correct issue with omitting federal withholding?

03 Sep

I sent in a 2006 tax return in 2009. My brother received his return. I called the IRS customer support line, and they told me that I did not report federal withholding, thus meaning I was not due a return. I do not have a copy of my return to prove otherwise, as I was due back all of my withholding.

If the state owes me and I am filing my state tax return late do I get a penalty or anything?

24 Aug

I live in Indiana and while cleaning out my desk just found my 2008 State Taxes that some how got filed instead of mailed. The state owed me about $250. I would like to go ahead and file them but am not sure if I need to do any extra forms now to do so or what? Is there a penalty since they owe me? Any help is appreciated.

If a civil case forces you to return prior income, can you adjust your previous tax returns?

22 Aug

Say my business make 100k this year. And next year, a civil suit claims that income was an ill-gotten gain, and I have to settle and return the 100k I made.

Can I go back and amend my prior year’s tax return and get a refund for the taxes I paid on my 100k income, since that income is now 0? Or do I claim a loss on the present year income, because that would be catostrophic given that I cannot recover the taxes paid.
P.S. Yes, I will talk to an accountant next week, but I just wanted some idea for now.

I always do my own taxes online and we are buying a home and qualify for the $8000 homebuyer tax credit. I am trying to find out if I can file the amendment or if I have to have a tax professional to do it?

What is the law about not filing a tax return when you owe nothing?

09 Jun

This question is just theoretical since you would be throwing money away. If the amount withheld from your pay is greater than or equal to your tax liability are there any criminal repercussions for not filing a tax return? All penalties are based on percentages of the amount owed. Please don’t just give me what you think. Please give me a link to the specific law and criminal penalties. Every law I can find is for not paying your taxes, not for not filing.
Many people say that the IRS says you have to file. I have seen that statement. My question is what happens if you don’t file. If you owe nothing can they send you to jail for not filing? All I am asking is to please point out the penalties.

Do I have to file a RI state tax return when I have no income from RI and I live in MA as a student?

08 Jun

I have been living in MA all year as a student and have no income from RI, only MA income. However, I continue to use my parent’s RI address as a permanent address, including on my Federal 1040 form. I have no intention to return to RI after graduation so I do not consider myself domiciled there. Do I still have to fill out a RI state tax return? Thanks in advance for any answers.

If a married couple changes from a joint tax return to two returns, does this affect the total amount on tax?

07 Jun

The couple lives in Michigan. The husband is contemplating moving to Illinois to accept a job that would require him to live in Chicago. His wife would continue to live in Michigan. Therefore, they would have to file separate individual tax returns instead of a joint return. All other things being the same, would they have to pay more taxes in total because of having to file separate returns?

I am 20 years old and I still live at home with my parents and they also pay for my college. What is the income amount that does not require me to file an income tax return? If I made $14,000 that year, would I need to file an income tax return?

HR Block Online Tax Return Error?

06 Jun

I am doing my 2009 taxes using HR Block’s online software. It is allowing me to claim as a dependent a 20 year old son who lived with me for the entire year but was not a full time student. I think this is an error. If it is, how could their software be that screwed up?

Should the IRS stimulant payment be divided the same as the tax return as agreed to in the divorce.?

06 Jun

I got divorced in February. My ex is claiming that we should split the stimulus check in the same way that we split the tax return (70/30). In his favor of course. I have suggested that we split it fifty-fifty for everyone but my child, who he pays nothing for. He does not agree and suggests that I contact my lawyer because I am wrong. Does anyone know how this should work?
